Ontario Law Reform Commission: Report on The Law of Charities

One of the most recent and exhaustive studies on the law of charity was carried out by the Ontario Law Reform Commission. Days after the Report was released, the Commission had reached the end of its term. The Report was published on the Internet and a few hard copies are located in Law Faculties in Canada. About a year later, the Commission's web site was discontinued, making access to the Report very difficult.

The Program on Nonprofit Corporations, Queensland University of Technology was able to secure the agreement of the Ontario Minister of Consumer and Commercial Relations to publish the material at no charge provided the source of the material was acknowledged.

QUT express its thanks to the Ontario Government for permitting the publication of this Report.

Alert Services

Alert Services are email services that will alert researchers to any new articles or books using authors, subject classifications or key words in abstracts. Subscription to an alert service allows students/researchers to keep abreast of the literature in their area of interest. Centre staff most commonly use ProQuest or Wiley Interscience but others are listed on the Library website. The university librarians can assist you to subscribe to appropriate services and decide on the appropriate key word triggers. Or sign up yourself by visiting the database and looking for their "Setting Up An Alert" menu or button. Or print a copy of Directions for Setting Up Alerts in ProQuest or Wiley Interscience and follow along (Word document).

Most alert services and research databases are accompanied by a Direct Document Delivery service which allows you to order (at your own expense) faxed full text journal articles. Staff and postgraduate students can also use QUT library's Document Delivery service to order copies. Access via QUT Library website Document Delivery page.

Nonprofit Statistics Resources

The ATO Compliance Program 2003-4 states: "There are 700,000 non-profit organisations in Australia, but only 170,000 of them are in the tax system 94% of these are companies, and the remainder trusts. Combined annual turnover of non-profit organisations in Australia exceeds $27 billion. The 30,000 largest non-profit organisations employ 8% of Australia’s workforce. So while these organisations pay less than $1 billion in tax, their role is significant because they collect around $5 billion of tax paid by their employees, representing around 5% of total PAYG withholding."

In Australia there are approximately 10,000 public companies limited by guarantee and over 100,000 state-based associations. With regard to state-based associations, the Department of Fair Trading in each state provided these figures in February 2005:

NSW 33,000
QLD 20,000 active; 23,674 in total
VIC between 37,000 and 45,000
TAS 3,200
WA 18,000
SA n/a
ACT 2,442

Giving New Zealand Philanthropic Funding 2006 Slack, A.

The study examined giving from three sources: trusts and foundations, individuals and businesses. These sources made the following contributions to total estimated monetary giving in the 2005/2006 year.

Total estimated giving equates to New Zealanders giving 0.81 percent of New Zealand GDP to philanthropic causes. New Zealand’s giving as a percentage of GDP compares favourably with those of Canada, Australia and the United Kingdom for 2005/2006.

United States Charitable Giving Survey

Newtithing Group, an American not-for-profit organization, has published Wealth and Affordable Donations in Uncertain Times, a report that details giving trends and patterns since 1997. The report discloses an interesting finding: some of the country’s wealthiest taxpayers contribute more to charity than the amount they are permitted to deduct for income tax purposes.
